Terms and Conditions

  1. Eligibility: Service Champions Client Referral Contest is limited to legal residents of the United States who are at least 18 years old and are current clients of Service Champions. Employees (including immediate family) of Service Champions and affiliated companies, as well as their advertising and promotional agencies, are not eligible. By entering, the participant agrees to these terms and conditions, and the decisions of the Sponsor (Service Champions), which are final and binding in all respects.
     
  2. Promotional Period: The promotion runs from May 17, 2010 8am (PDT) through July 15, 2010 at 11:59:59 pm (PDT).
     
  3. Entry: Potential participants of the Client Referral Contest will receive a postcard mailer or other information inviting them to access a URL at http://www.servicechampions.net. The recipients and other marketing communication will be determined by Service Champions. No prior or subsequent purchase is necessary to be considered a potential participant or to enter or to win. Each participant should complete the form as directed on the Client Referral Contest page and hit the submit button. All entries must be complete with the participant’s legal name, phone number and email address. By registering, the participant agrees to share valid contact information of friends and family members to Service Champions. Service Champions will be contacting those referred to us with a special offer to provide an air conditioning tune-up service at a significantly reduced cost. The participant is welcome to enter the contest as many times as he/she wishes. Each referred name counts as an entry into the contest. Participants may also supply referral contact information by US postal mail to Service Champions Client Referral Contest, 7020 Commerce Drive, Pleasanton, CA 94588, or directly hand-written on a referral sheet provided by a Service Champions team member. Entries must be received by 11:59:59pm July 15, 2010 (PDT).

    Service Champions assumes no responsibility for lost, late, incomplete, stolen, misdirected, or illegible entries, or email; or for any computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, availability or garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability, traffic congestion, or technical failures, or unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information.
     
  4. Random Drawing: The winner will be selected in a random drawing on July 16, 2010, from among all eligible entries received.
     
  5. Prize/Odds: The contest prize is an all-inclusive, all-expenses paid trip for two (includes airfare, lodging, food and beverages) to the Riu Resort in Cabo San Lucas (approximate value $2,000). Winner has one year from selection date (until July 16, 2011) to claim prize and arrange trip with Service Champions and/or its travel agency. The odds of winning will depend upon the number of eligible entries received. There will be 20,000 potential entrants, each having multiple opportunities to enter. Void where prohibited by law.

  6. General Conditions: Winners’ names will be posted on the www.servicechampions.net website for one month after the drawing. A representative from Service Champions will notify the winner and award the prize. If the winner is found not to be eligible or not in compliance with these terms and conditions of the Client Referral Contest, the winner will be disqualified. The winner will be responsible for expenses traveling to and from the airport, both at the departure airport and the destination airport, any incidentals or expenses outside the Riu Resort. By accepting this prize, where permitted by law, winners grant to Service Champions and those acting pursuant to Service Champions, authority (and agree to confirm said grant in writing) the right to use and publish his/her name, portrait, picture, voice and likeness for advertising, trade and promotional purposes without additional consideration, worldwide and on the World Wide Web, without notifications, review or approval.

    By participating, each participant releases and agrees to hold harmless Service Champions, its affiliates, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injury, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, or participation in any Service Champions Client Referral Contest related activity. Unclaimed prize may not be awarded.

  7. Limitations of Liability: IN NO EVENT WILL SERVICE CHAMPIONS OR ITS AFFILIATES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ACCESS TO AND USE OF INTERNET SITE WWW.SERVICECHAMPIONS.NET OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FIRNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
     
  8. Choice of Law: Except where prohibited, entrants agree than any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorney’s fees; and under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions of the contest, or the rights and obligations of entrant and Service Champions in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine, and all proceedings shall take place in Alameda County, California.
